EOHR demands delegating a judge to investigate in the referendum day assaults

The Egyptian Organization for Human Rights (EOHR) is anxious towards the decree held by Counsellor Maher Abdel Wahed, (the General-Prosecutor) to freeze prosecuting in the physical and sexual assaults committed against journalists and Opposition in the referendum day, which determines the amendment of Article 76 of the Constitution, in which the Counsellor's decree no. 7165 [2005], registered no. 12 [2005] states 'The litigation is not necessarily held, in which there is no evidence declaring the doer of the assaults'.
By the way some journalists, Abeer al-Askary, Shaimaa Abu Al-Khair, Eman Taha and Rasha Azab - who have been assaulted - presented their testimonials to EOHR stating their subjection to sexual assaults from Ruling National Democratic Party (NDP) trouble makers and some hired women, the incident happened before the security apparatuses' supervision !!.
The incident held during which the journalists were covering the Egyptian Movement of Change (Kifaya -Enough) movement demonstrations against the referendum held to amend Article 76 of the Constitution and stating Article 192 (repeated), Later they were threatened by some security forces' heads, making up trials they didn't make, arrests against them and their families and fire them from their work. The threats came before presenting their declaration to the General-Prosecutor which determines the competed description of the people who committed the assaults.
On this domain, EOHR confirms that the committed assaults against journalists and Opposition are considered an abuse against all principal human rights, the right to life; the right to freedom and personal security and right of physical safety from torture, all are stipulated by international human rights instruments and the Egyptian Constitution.
EOHR accordingly, calls the Minister of Justice to delegate a judge from the Appeal Court to investigate in the assault trial, in which Article 65 of Criminal Procedures Law states 'The Minister of Justice has the right to delegate a Counsellor judge from the Appeal Court to investigate in a certain crime or a particular crime, and the delegation must be held via a decree from the General-Assembly, provided that the counsellor is the sole person who is responsible for investigation'.
In addition, EOHR calls the counsellor to investigate in the trial rapidly and to gather all information, documents and all the necessary details which helps in checking out the incident's circumstances and people who have done it, he must also present the investigation results and transfer the doers of the assault immediately to the criminal courts;
on this pretext also EOHR calls the Interior Minister for making immediate procedures to arrest who committed the assaults, in which the incident was spread all over media instruments.
