At the conclusion of a workshop held by the Egyptian Organization For Human Rights supported by the European Union on 18/2/2008 under the title of “ Regional And International Legislations To Fight Terrorism ……….. Lessons Learned” , participants called for the necessary for pulling out the secrecy encircled the committee of new terrorism draft law and the necessary for involving all political ,partisan and society forces in the discussion that carried out and declaring the features of this bill to the public opinion .
Participants of law professors , members of the parliament ,representatives of political parties and human rights activists clarified that laws which issued in most of world countries to combat terrorism were not established to restrict the freedom of citizens in this country as far as it restricted the freedom of migrants who live there .Participants accentuated that the absence of democracy and citizens participation in the public affairs are the main reasons for the escalation of terrorism phenomena .
Mr. Hafez Abu Seada , Secretary-General confirmed that There are no pressures or international obligations that force Egypt to issue a new draft law for terrorism . The issue of terrorism came within Mr. President Hosni Mubarak promises to issue terrorism bill instead of state of emergency in Egypt .
The United Nations had developed a set of standards to combat terrorism at the level of world countries , these standards focused mainly on eliminating the causes that lead to its emersion , among these causes are the absence of social justice, and the control of small group of national wealth unlawfully and political despotism . These causes led to the emergence of most terrorist groups in the world.
The United Nations has developed solutions to the crime of terrorism, and these solutions are based on consolidating democracy, and strengthening the participation of citizens in public affairs, and preventing the collection of donations which support terrorist groups, and criminalizing states that supplied these groups with weapons .
All terrorism laws that issued in the majority of countries in the world pressed on human rights, but at the same time granting the executive body more power to restrict freedoms of citizens will make life very difficult for people , all citizens can endure the pressure of economic life, but the loss of liberty and the violation of their rights and their bodies can not be afforded , Abu Seada indicated.
Dr. Tharwat Badawi, professor of constitutional law at Cairo University , expressed his refusal concerning using any legal texts related to terrorism ,pointing out that all these texts which were issued in the west world mainly intended Muslims and immigrants specifically, and not the country's population as he described .
Dr. Badawi confirmed that the existing criminal laws in Egypt and the Anti-Terrorism law No. 97 - 1992 to confront the terrorist crime are adequate and there is no need for a new law to fight terrorism.
Mr. Subhi Saleh, member of People's assembly , has described that the issue of fighting terrorism has become a global fashion, particularly after the events of 11 th of September. Western governments have exploited these events to grant wider powers to security bodies to criminalize any organization, or prevent any meeting or impose
Restrictions on travel and confiscating documents, besides lengthening the period of detention for suspects.
Mr. Saleh emphasized that its not true for the Egyptian legislator to quote from the international laws that combating terrorism, because each country has its political and legislative environment and legislation comes to reflect this environment ,so resorting to the international laws is not a suitable process to be applied in Egypt .
Concerning the features of the new law of terrorism, the representative explained that most of information we get concerning this law indicate that it consists of 59 articles while the Emergency Law consists of 20 articles , so the new law will be incontestable and above the Egyptian Constitution as its articles will be fortified by Article 179 of the constitution .It will be more dangerous than the Emergency Law, it is constant and not temporary, and civilians will be submitted to military courts accordingly.
Mr. Essam Shiha ,member of the Supreme institution for El Wafd Party ,confirmed that every terrorist crimes in Egypt has been committed in the presence of the exceptional laws specifically in the presence of state of emergency .Egypt is not in a short need for a new law .He pointed out that the Egyptian law No. 97 1992 was the only law in the world that set a definition for the crime of terrorism, even United Nations had strongly criticized this law when issued , and described it as an arbitrary.
Mr. Shiha called the political and partisan forces to move against Terrorism Bill supposed to be issued by government , particularly that most of National Party (NP )members are able to pass this bill as well as they pass the case of constitutional amendments .
Dr. Mustafa Kamel ,professor of political science and member of the Board of Trustees of the Egyptian Organization for Human Rights clarified that laws and legislation relevant to combating terrorism in all nations of the world – despite varieties - will not prevent terrorist groups from doing heinous crimes against humanity. He confirmed that the absence of democracy, the suppression of freedoms, and rising rates of poverty and unemployment provide a fertile environment for spreading terrorist crimes in different countries. So getting rid of terrorism crime need to consolidate democracy , spread the culture of human rights , build a state of law and institutions, fight corruption, and eliminate the causes of poverty and unemployment.
