First: the
Cases of the Illegal Detention:
In this section, EOHR monitors 11 cases, concerning the
arbitrary detention without any charges, and 11 cases, concerning the death of
citizens inside the police stations because of torture or ill-treatment. It was
clear that torture has been practiced in most police stations in a wide-range,
according to the information that EOHR has received during its campaign against
torture and ill-treatment of citizens inside the police stations from 2001
January to 2002 March. EOHR was very doubtful about the death of many citizens
because of torture and ill-treatment by the policemen in police stations. All of
field investigations, the fact-finding missions, the reports of the
investigations and the forensic medicine proved that these victims were tortured
till death by the policemen during the detention period and that breaches the
recommendations of the UN committee of human rights. This committee asserted
that the detainee shall be informed of the cause and place of detention and has
the right to present a written or oral complaint.
Moreover, torture not only degrade the victims, but
this report also proves that torture detract them from their right to life.
This report includes cases of many victims who died as
a result of torture and ill-treatment as follows:
1- El-Waraq and 6th
October police stations:
Name: Ebrahem Moussa Souleman.
Age : 63-year old.
Address: 111 El-Bouhy st; Embaba ; Giza.
Case:
On 25\2\2002, he was arrested by a police force from
the investigation unit in El-Waraq police station.
He was taken to El-Waraq police station, where he was
detained for 4 days. On 1st March 2000, he was taken to 6th
October police station, where he was detained for 5 days without any charge. The
detention of the aforementioned lasted till his brother , Abdallah Nour, who was
accused of murder in 6th October City , was arrested .
On 9\3\2000, the EOHR presented a complaint no.160 to
the head of El Haram prosecution, and the head of 6th October police
station.
During his detention, he was subjected to several
violations, such as insulting and beatings in different parts of his body.
On 6\9\1999, the EOHR presented complaint no.629 to the
head of
Security Directorate, Public Persecutor, and the
Ministry of Interiors.
2- El-Saff police station:-
Name: Aly Abdo Aly
Age: 35- year old
Address: El-Soubek- El-Saff- Giza
Case
On 29\12\2001, the police force of El-Saff police
station arrested him and ordered him to work as a detective. However, when he
refused to do so, the officer of investigation Unit in El-Saff police station
sent him to El-Saff prosecution with the charge of having drugs. Although he was
sent to the police station to be released on bail, according to the prosecution
order, he was detained for 8 days without any legal reason in the police
station.
On 30\12\2001, Sha’ban Tammam Muhammad was arrested
by an officer and was presented to the prosecution. He was accused of having
drugs because he refused to work as a detective ( as his family said) Although
the prosecution decided to release him on bail, which he paid, he was detained
in the police station without any legal charges.
On 1\1\2002, Aly Fahmy Mouhab El-Dein was arrested and
sent to prosecution with the charge of having weapon without license. Even when
the prosecution decided to release him on bail, which he paid, he was detained
without any legal reason in the police station.
In this regard, on 6\1\2002 EOHR has sent complaint
no.17 to the authorities.

The Detention in El-Salam police station:-
Name: Said Sameir Muhammad

On 5\8\2001, he was arrested by
Mr. Muhammad Abdel-Salam, the investigation
assistant of El-Salam police station, at 6:30 p.m. He was taken by the police
force, headed by officer, Youssef El-Adly, to unknown zone. When his family
searched him and found him in the Security Directorate of Cairo, where he was
detained for a day, and was sent to El-Nozha police station, where he was
detained for 5 days.
On 13/8/2001, EOHR sent
complaints to the authorities, the public prosecutor, the Minister of Interiors,
the head of the inspection and supervision department, and the head of the
public relationships and information in the Ministry of Interior.
4-
El- Darb El-Ahmer police station:-
Name: Maher Farag Mousa

Case:-
On 15/5/2001, he was
arrested and detained for 23 days without any legal reason in El-Darb El-Ahmer
police station. He was subjected to ill-treatment as follows:-
1-His hands and legs were binded.
2-He was hanged on a window.
3-He was subjected to beating .
On 5/6/2001, EOHR sent complaint
no.83 to the officials, the Minister of Interior, the public prosecutor, the
general attorney and the head of El-Darb El-Ahmer prosecution.

Embaba police stations:-
Name: Anterr Hassan Aly Saddiq
Age: 23-year-old

Case:
He was charged in an
administrative case No.2679 of 2000, and was detained in Embaba police station
for 30 days pending investigation.
On 28/3/2000, he was
released from the prosecution. However, he was deported to Embaba police
station, where then he was detained till 14/4/2000, and then he was deported to
unknown place, where he was detained till 29/4/2000.
On 29/4/2000, EOHR
sent a complaint no.271to the officials, the minister of interior, the head of
Giza prosecution, the public prosecutor.

El-Saff police station:-
Name: Nazih Tammam Muhammad
Age: 33-year-old
Address: Giza; El-Saff; El-Shoubak
case:
On7/1/2002, he was arrested and detained
in the investigation unit of El-Saff police station without any reason and for 4
days.
During his detention, he was subjected to
ill-treatment as follows:-
1- He was blindfolded.
2-He was chained
3-He was beaten
4- He was insulted .
On 14/1/2002, presented a complaint to the
authorities, the public prosecutor, the minister of interiors, the head of El-Saff
prosecution, the head of inspection and supervision unit in the ministry of
interiors.

EL-Saff police station:
Name :Shab’an Tammam Muhammad
Age: 27-year-old
Address: Giza; El-Saff; El-Shoubk El-Sharky
Case:
On 2/1/2001, he was arrested by the
officers of the investigation unit in El-Saff police station and was ordered to
work as a detective. When he refused, he was deported to El-Saff prosecution and
charged with having drugs. Then, he was released on bail on 5/1/2002. After that
he was deported to El-Saff police station, where he was detained in the
investigation unit without any reason for 6 days. During his detention, he was
subjected to the ill-treatment as follows:-
1- He was hanged on a door for a long time.
2-His legs and hands were bound.
3- He was beaten with sticks on different parts of his
body.
On 9/1/2002, EOHR sent an urgent appeal to the
officials, the public prosecutor, the head of El-Saff prosecution, the minister
of interior, and the head of inspector and supervision department, with a
complaint No.23.

El-Agouza police station:

Ashraf Muhammad Aly El-Shenawy

case:
On 21/10/2001, he was arrested and deported with
his kid to El-Agouza police station, where he and his kid were detained in the
investigation unit for a day. He was forced to sign an empty form in order to
release him with his kid, who is 6-year old and has a heart disease. He thinks
that the officers do all those acts to force him to settle some financial
matters with his wife. In this regard, EOHR sent an urgent appeal to the
officials to investigate his detention without any reason in El-Agouza police
station.
9-Madent
Nasr police station Two:-
Name:
Wae’ll Muhammad Tawfeq.
Age:
28-year old

Bani Souaff; El-Feshnn; El-Qaddaby.
case:
On22/1/2002,Tuesday, he was arrested by four
officers, one of them was a security state officer, in El-Maradd st in the
International Book Fair in Cairo. He was taken to the police station of the
fair, after that he was detained in Nasr City police station 2. Four hours later
, he was deported to the state security building in Lazoghli where he stayed for
two days during which he was subjected to ill-treatment in the following forms:
-blindfolded all the time of his detention .
-beaten on different places of his
body.
10- El Wasta Police Station
Name:
Ali Sayed Abou Se’ree.
Age:
21 years old
Address:
El Wasta – Tera’a El Leil – Building no.74 next
to El Ahli Bank – Beni Sweef.
Case:
On 6/2/2000, he was arrested by an
officer as he said, some soldiers and one of Aly’s neighbors, who is in conflict
with Aly on a building. He had been beaten in his flat, which has been
destroyed, before he was taken to the police station of El-Wasstta, where he was
detained without any legal reason. He was subjected to ill-treatment as
follows:-
1- He was blindfolded, and his hands were
chained up.
2-He was hanged on a door and beaten with a whip
irregularly.
3-He was beaten.
4- He was beaten on his kidney and so he
fainted.
He was detained till 2:00 pm on 7/2/2000.
On 10/2/2000 , EOHR sent complaint no. 148 to
the officials, the public prosecutor, the minister of interior, and the head of
inspection and supervision, in order to investigate the legal reasons for his
detention and the torture.
11- Police Station of Omraneyya

The Case:
He was
arrested by the police station of Omraneyya on the 5th of November
2001 and sent to the police station, where he was kept in one of the rooms of
the state security Investigations office. At 11:30 he was presented to the head
of the state security Investigations office and during the Investigations he was
harassed and badly treated and this lasted for the three days that he spent in
the state security Investigations office. During this period of time Moheb was
treated as following:

beaten up with hands on
the face and also binding his eyes

tying his hands and feet
and hanging him around a wood stick with a rope
-
electric shock in the
toes of both feet and the chest from the left side
EOHR sent a
complaint to the officials in order to call for an investigation in the
imprisonment of the above mentioned person and the harassment and bad treatment
he received while he was there. The complaint number is 134 on the date of 28th
of October 2001 and it was sent to all of::- (the Public Prosecutor, the
Minister of Interiors, and the head of the Inspection Administration in the
Ministry of Interiors).

Cases of Deaths within the Police Stations
1-Police
Station of Hadaek El Kobba

The Case:
On the 3rd
of January 2001 at 7:00 am one of the police officers arrived with a police
force from Hadaek El Kobba police station to the house of the above mentioned
person, who was arrested because one of his former enemies was a police
officer. This person asked the family of the victim to pay an amount of money
in order to let him go, but the family refused.- So a decision was made to
arrest the above mentioned person and to imprison him in Wady Natroun prison,
but his father appealed and he got his son's release on the 8th o
January 2001 and Mohamed was moved from the prison back to the police station of
Hadaek El Kobba.
-On the 13th
of January 2001 the family of Mohamed got the news about their son's death in
the police station of Hadaek El Kobba. Here the father tells us what happened
on 13/1/201: "A person arrived at our place and told us that Mohamed arrived to
the Hadaek El Kobba police station and that he died and is lying in the corridor
of the state security investigations office. We went to the police station and
found Mohamed lying in the corridor as we were told and he was wearing white
trousers only and the signs of lots of beating were all over his arms, neck and
chest and also signs of electric shocks were there, too. Around the shoulders
and feet there are marks of rope and during this I called for a health
inspector, who examined the body, which lost blood from the nose, ears and
mouth, and all this was written down in the interrogation. The prosecutor asked
the police officer/ Hamdy and the police officer/ Mahmoud Farrag and the head of
the state security intelligence of the police station of Hadaek El Kobba, and
they all decided that Mohamed came to the police station tired and suffering
from pains in his heart. The prosecutor wrote down the bruises found on the
body and they were put in the report number 399/2001 administrative Hadaek El
Kobba.
The body was
moved to the Zeinhom morgue, where samples were taken for the analysis and in
order to find out the reason of Mohamed's death. A police car was present
during the funeral and the burial. The Family made a complaint accusing the
officers within the state security investigations office of torturing the
citizen/ Mohamed Samir Aboul Wafa until his death.

Station of Ein Shams

The Case:
During the month of March 2001 the citizen Khaled
Mohamed Ahmed was arrested with 3 of his friends and they were put in the Ein
Shams police station and were accused of taking drugs (bango) and they were sent
to the prosecution of Ein Shams and the prosecutor decided to let them out after
paying an mount of 50 LE each.
-The state security investigations office of Ein
Shams police station released the 3 friends, but Khaled was kept in the police
station without any legal reason, and he was kept there for a couple of days
until his family was told by the head of the state security investigations
office by telephone to go to the police station in order to receive the body of
their brother, where the family was told that Khaled died because of an over
dose of drugs.
-The family made a complaint to the prosecution
of Ein Shams accusing the police officers in the Ein Shams police station of
killing the citizen Khaled Mohamed Ahmed. This accusation came after the family
got to know through the medical report, that the death of their son was caused
by haematomata (blood collection) in the head, which is in accordance with the
story they heard from the police station. EOHR sent complaints to the officials
asking for a closer investigation of this case.
3-Second
Police Station of Shoubra El Kheima

The
Case:
On the 27th of March 2001 at 7:30 am,
while Mosaad was having breakfast with his mother and other people, the officer
Abdel Nasser Zidan of the state security investigations office of the second
police station of Shoubra El Kheima and his assistants raided the house and the
officer shot 3 shots on Mosaad: one hit Mosaad's left eye, another between his
eyebrows, and the last in his chest. After one hour of shooting Mosaad a small
police car came to the house and took the body rapped in a blanket.
-The mother says the story as following: "It was
about 7 in the morning when I was out of the house throwing the garbage when I
found Mosaad, my son, standing on the street chatting with his friends. I asked
him when he came back from the village- he said I came to give you the money
that my brother is sending to you, because Mosaad was working with his brother
in Menya Samnoud. He was standing with his friends talking and he told me that
he wanted to have breakfast, so he gave me the money and I bought breakfast-
fool, bread and ta'meyya. When I came home, I found his friends so I invited
them over to have breakfast with Mosaad, so they came and sat on Mosaad's bed
and we all ate breakfast together. I went to the kitchen to get water for
Mosaad, the house door was open and an officer with two detectives came in and
he asked me about Mosaad and told me that he came here to kill my son. He stood
at the door of Mosaad's room and shot him while saying: I came here to kill you
son of a "…". When they shot him I started screaming so he said to the two
detectives: take this woman, the daughter of a "…" downstairs. So they dragged
me to the floor below us and they dragged Mosaad's friends to their police car.
On my way downstairs I heard my son screaming three times then he was silent.
An hour later we heard the noise of a car entering the street, which was a small
police car. After a while I saw them getting out of the house with my son
rapped in a blanket, and the officer looked at me and said: Didn't I tell you
that I will kill him? And here I killed him and I will take him, and we will see
what you can do, you daughter of a "…". I fainted and afterwards the
prosecution came and heard my words. They took the blanket and the bullets
which fell under Mosaad's bed and I did not see my son again until the day of
his burial, when the police was the one burying him.
Witness/ Hanem Ahmed El Mody, the owner of the
building, where Mosaad was living:
"At about 7 in the morning I heard noises from
above so I opened the door and called on Omm Mosaad "what's going on?". Then I
found two detectives dragging her to my apartment and she kept saying that they
will kill Mosaad. Afterwards we heard Mosaad's voice twice, then there was
silence until the police car came and Mosaad was rapped in a blanket and his
blood was pouring out of it. A while afterwards they came and searched my
apartment and the officer told Omm Mosaad: You see, I killed him. Now show me
what you can do".
Eyewitness
Brother-in-law of Mosaad.
He saw Mosaad in the morgue when he went to
receive his body, and he found Mosaad shot: - between the eyes

The family
made a complaint to the Public Prosecution accusing the officer Abdel Nasser
Zeidan of killing Mosaad Ahmed El Sayyed Abou Seif deliberately.

4-Police
Station of Badawy Village

The Case:
On the 29th of March 2001 Ashraf
Ibrahim El Sharkawy was arrested by a police force from the police station of
Badawy village, El Mansoura governorate, and this because his father made a
complaint to the police accusing his son of bad behavior, but what happened is
that Ashraf died a couple of hours after he arrived to the police station.
Afterwards the body of the above mentioned person was sent on a car back to his
house, where the father was outraged when he knew about his son's death. He
carried his son's body back to the police station and a number of the village
inhabitants gathered around the police station, where they shouted slogans, but
after a while the crowd was kept under control when the leading police officers
of Dakahleya security arrived to the police station.
The inspection done on the body of Ashraf showed
the presence of "injuries in the feet and knees of the above mentioned person"
and also there is and investigation by the prosecution of Mansoura governorate
in the death case of Ashraf inside the police station of Badawy village. The
prosecution also decided to call for a forensic doctor in order to find out the
reason for the death, the date of the death and whether Ashraf was killed or
not.

5-El Raml
police station

The
Case:
On the 25th of April 2001 a police
force from El Raml police station arrested the above mentioned person in front
of his house. The police arrested Hussein, took of all his clothes, started
beating him all over and also dragged him on the floor until he reached El Raml
police station. As soon as he arrived there he was interrogated and in the
interrogation it was written that a pocket knife without a license was found
with Hussein, so he stayed in the police station until the next day, when he was
presented to the public prosecution, which ordered his release with the
guarantee of his home. But the decision of the prosecution was not executed and
the above mentioned person was held in the police station without any reason.
Furthermore, the security men of the police station did not allow the father of
Hussein or any other relatives to enter the police station or even to send food
for their son. In the morning of the 30th of April the father of
Hussein was called by El Raml police station and as soon as he met the head of
the state security investigations office, he was told that his son died as a
result of taking drugs, which caused an acute circulatory failure, and that his
son's body was already moved to the morgue. After the father of Hussein saw the
body of his son, he found bruises, injuries and marks of torture all over his
son's body. The forensic doctor examined the body in order to identify its
bruises, how they most probably were done, their date of happening and whether
this is a criminal case or not.
The police forced the father of Hussein to carry
the body and burry it in the presence of the police without informing any
relatives. The police also threatened him that if he informed anyone of what
happened, then the rest of the family will suffer like Hussein did. EOHR made
complaints to the officials in order to investigate this case.

police station of Nasr City -1

The Case:
On the 29th of April 2001 while the
above mentioned person was held in police custody for the time of the
interrogation in the First Police Station of Nasr City, his wife/ Shaima'a Abdel
Hamid was caught putting narcotic substances in his food. She was put in the
women's jail in the police station and when her husband knew about that he was
outraged. So the police officers harassed him, beat him all over, and put him
in a room alone within the police station, where they undressed him and ordered
him to stand on a pile of bricks that was inside the room. As soon as they left
the room he got dressed, but when the police officers came back and found that
he did not obey them, they again harassed him, but this time they found he had a
sharp metal instrument in his hand (the arm of a spoon), and he started accusing
them of flirting with his wife, but they were able to tie him up and they pushed
him on the pile of bricks and started beating him up all together with the
police officer, the accused (Ahmed Saber Aly), who pushed his pocket knife into
Nader's body. Then they dragged Nader out of the police station while still
beating him.
The report of the forensic medicine described the
injuries as following:
1-
Bruises of the victim on
his face, forehead, neck, chest, left shoulder, back- these are fresh bruises
which occurred because of a contact or hit with a solid body or bodies with a
rough surface whatever its kind and it could have been caused as it was
mentioned in the report of the prosecution.
2-
Cuts present in the back
of the left foreleg are fresh cuts with a cut wound, which happened because of a
hit by a solid body or bodies with a sharp edge whatever its kind, and these are
slight cuts in their nature and they included only the skin layers and did not
reach the muscles.
3-
The cuts described in the
report and which were seen on the left hand are fresh and deep-reaching to the
fat layer under the skin. They occurred because of a hit with a solid
instrument with a sharp edge, which could not be the instrument described in the
repot.
4-
The described cut and the
view of the forelegs' tissues as a result of the stabbing by a solid instrument
with a sharp edge and a pointed corner whatever its kind, might occur as
described in the report, by using a knife or something similar, but it might not
occur by using the other metal instrument (the spoon's arm) and the use of this
instrument resulted in a deep cut of one the primary foreleg veins.
5-
The cause of the death is
mainly the deep cut in the left foreleg, which resulted in a cut of the left
foreleg vein. This cut was followed by strong bleeding, which resulted in an
acute circulatory and respiratory failure.
The General
Prosecution accused Ahmed Saber Mohamed Aly El Sayyed of the following:
Beating the
victim Nader Fathy El Sayyed with a pocket knife in different areas of his left
leg which caused several cuts and injuries mentioned in the report. He did not
intend to kill him, but the beating led to the victim's death as explained in
the reports.
He possessed
a pocket knife in the absence of a personal or occupational necessity.
The case was
registered under the number 687/2001 and it was sent to court, and many sessions
took place. On the 16th of February 2002 the court ruled on the case
of the accused Ahmed Saber Mohamed Aly El Sayyed the following:
First: Ahmed
Saber Mohamed Aly should spend 7 years of hard labor and pay the court expenses.
Second: To
refer the case to the specialized, primary Court of Northern Cairo without any
expenses.

Police Station of Kowisna

The Case:
(Testimony of the victim's family)
-
On the 29th of
October 2001 the citizen Ahmed Taha Hussein got into an argument with a
detective infront of his house, and the detective promised Ahmed that he will
come back for revenge. After a couple of hours the detective came back with a
number of other detectives and police officers who arrested the above mentioned
person and dragged him to the police station of Kowisna at about 7:30 pm of the
same day under the pretext that he has to meet the head of the state security
investigations office. As soon as he was in the state security investigations
office they started harassing him with no reason and the torture continued until
11:00 pm, the "hour of death", and then he was kept in detention in the police
station. When the officer in charge came to work, he asked the other prisoners
about him and they told him he was asleep, but later he found out that Ahmed was
dead and he informed the prosecution.
-
The prosecution went to
the police station of Kowisna, where the body was examined and this continued
until the early hours of the next day, when the prosecutor re-examined the
agenda of the police center's affairs and he found "eleven mistakes".
-
The prosecution
interrogated all the officials within the police station about the case and the
torturing of the above mentioned person. But during the interrogation, the
answers of the officers and detectives were contradicting. The security forces
buried the body and did not allow any of Ahmed's relatives to leave their houses
and this continued for another day during which they were harassed and beaten
whenever they complained about or objected to what happened.
The report of the forensic doctor proved the
following:
The
head (Intact, congested scalp-congestion of brain tissue)
The neck (Trachea showed white foam)
The chest (Heart normal)
The stomach (Intestines are generally intact and
congested except for the liver, which showed a degree of fibrosis and the
urinary bladder, which was full of dark colored urine)
The samples (Chemical analysis no. 692K of tissue
samples taken from his intestines was clear indicating that the body and
intestines were free of any type of narcotic or poison)
The
opinion:
The body of the deceased Ahmed Taha Hussein did
not show evidence of criminal violence or resistance, neither by clinical
inspection nor by autopsy.
Results of tissue analysis of the body undertaken
by us showed that they were free of any narcotic substances or suspected
poisoning. Death was probably because of a pathological condition that was not
revealed by autopsy.

Police Station of Shobra Kheit

The Case:
On the 7th of December 2001 the above
mentioned person was arrested by two detectives from the police station of
Shobra Kheit who took him to the police station in order for him to meet with
the head of the state security investigations office. Only a couple of hours
later was he moved to a hospital, where he died there.
The family and relatives of Hesham went to the
police station in order to know the reason for his arrest, but they were told
there that he was sick and that they sent him to the hospital. Minutes later
the relatives gathered in front of the hospital door.
When one of Hesham's relatives was allowed to see
his body and he informed the rest of the family members of the injuries he saw
on Hesham's body, the relatives all gathered in front of the police station and
started throwing stones on the building, but they were kept under control by the
security leaders and no one was arrested or hurt during this incident.
According to his telling of the story, here is
how he described the body of Hesham:
-
long marks on the back
and shoulders- a swollen face and stomach
-
bruises on the body
because of beating with hands and wooden sticks
-
injuries in the arms-rest
because of tying them up- cuts all over the body.
The
prosecution decided to get a forensic doctor in order to identify the injuries
and bruises and to know the reason for the death of Hesham.
EOHR called
the officials (complaint number 229 of the date 26/12/2001) to investigate the
death case of the citizen Hesham Ahmed Abdel Ghany inside the police station of
Shobra Kheit.

Police Station of El Waily

The Case:
On the 23rd of February 2002, the
second day of the Bayram Feast, the above mentioned person found a police force
from El Waily police station asking about his brother, but when the police force
did not find the brother, they arrested Ahmed so as to force the brother to turn
himself to the police. So he was arrested instead of his brother and he stayed
in the state security investigarions office, where the police officers harassed
him and started beating him all over his body. During his stay in the police
station he was harassed as following:
-
tying up his hands
backwards with iron handcuffs
-
beaten with hands and
feet all over his body
-
beaten with an iron
handcuff on his chest, the back of his head, his neck and his chin
Following this treatment, the above mentioned
person lost his consciousness (or died) and was sent to one of the hospitals in
order to get a treatment, but the administration of the hospital refused to take
in the victim and decided that he was already dead. Nevertheless, the hospital
agreed to write a report in which it said that Ahmed came to the hospital with
some bruises and that he died later as a result of an acute circulatory failure.
In the morning of the next day (24/2/2002) the
victim's body was buried at 8:00 am and there was a big police and security
presence all through the funeral ceremony. This police force prevented the
victim's family of praying for him in the mosque next to his house and of
burying the victim's body in the tomb of his family in Salah Salem.
The eyewitness, who was tied up with Ahmed in the
same handcuffs confessed that Ahmed was beaten by an iron handcuff all over his
body; on his chest, neck and the back of his head, and when he asked for a glass
of water no one gave it to him, and within almost 3 hours the victim died.

Police Station of Nasr City - 2

The Case:
((According to what the relatives of the victim
said))
On the 26th of January 2002 Sayyed
Khalifa went out of Sokeil village with his friend Mostafa Helmy in order to
visit their friend, who lives in Nasr city and who finished his army duty. That
is why they went to visit him, in order to celebrate this occasion. Sayyed and
his friend did not return to their homes on that day and on the second day we
started looking for him and we asked about him in all the police stations and
hospitals in our area. When he did not appear until the 29th of
January 2002 we went to the police station of our village, the police station of
Oseem and we reported his disappearance and an interrogation of his
disappearance was written with the number 502 administrative Oseem on the 29th
of January 2002 (a copy of the interrogation is attached). On the 6th
of March we knew that Mostafa Helmy, my son's friend, was found on the street in
a very bad condition and that he was moved to Al Agouza hospital.
Mostafa informed us that Sayyed is in the
National Hospital of Bulaak El Dakrour, but when we searched for a while we
found out that there is no hospital with this name. So we started again
searching in the police stations and hospitals but we could not find him. On
that same day, Sheikh Mahmoud Lotfy, a member of the People's Assembly of Oseem
and El Warrak area, told us that Sayyed is present in the Second Police Station
of Nasr City and that Mostafa Helmy was threatened not to inform Sayyed's family
about that. And in fact, an interrogation was made in the police station of
Agouza on the torturing of Mostafa and arresting Sayyed in the Second Police
Station of Nasr City. Communication started between the police station of
Agouza and the Second Police Station of Nasr City, but after a number of trials
we could not find Sayyed and no one of the Second Police Station of Nasr City
told us where he was or what has happened to him.
In the morning of the 7th of March
2002 the Mayor of our village called for us and we found a police car taking
Sayyed's uncle, Aly Fahmy Atteya Kamal El Din, Sayyed's brother Diab and the
father, Khalifa Eissa, to the Zeinhom morgue in order to identify the body. And
in fact the body was identified by the uncle/ Aly Fahmy, who found some bruises
and injuries on the body.
An interrogation was written on this case in the
prosecution, and the body was examined by the public prosecutor, who identified
the injuries on the body. Also a forensic doctor was called to identify the
reasons for the death and its date of happening. On the same day at 7 pm we
were called by the general/ Abdel Wehab Khalil from the first police station of
Nasr City, who told us that we will receive the body the next day, where we will
pray on the body in the Sayyeda Aisha mosque. But when the family refused, he
cancelled the prayer and decided that the funeral will be in the presence of
security forces and that the burying will be in the tombs of the family inside
Sokeil village.
In the morning of Friday the 8th of
March 2002 we went to Zeinhom morgue, where we received the body at almost 10:30
am and afterwards the funeral started and was escorted by six police cars and
six central security cars. This continued until half the way, where only the
six police cars escorted us, but at the entrance of the village we found the
forces of Oseem police station waiting for us and they forced us to use another
road to the mosque next to the tombs. After the prayer the body was buried in
the tombs of the family and the security forces stayed until the funeral was
over on the same day.
The prosecution started its interrogation in that
case and a forensic doctor was called to identify the reason of the death. Also
the accused officers were interrogated and the witnesses said what they have
seen and the officers were arrested until the case was over.
The forensic report number 174/2002 regarding
case 1172 for the year 2002, criminal- Nasr City, registered by the collective
code of 165/2002 Northern Cairo proved that:

the victim Sayyed Khalifa
Eissa through the examinations was found to have the following bruises:
-
bruise seen and described
at the end of the genitals, which occurred by an electric shock
-
the injuries seen and
described at the back of the head and leg, which were caused by an instrument
with a rough surface of whatever nature
-
the rest of the injuries
seen and described at the end of the legs and arms were changed through time
because of the swelling and curing changes. But according to the description
before, these injuries occurred because of a hit with a solid instrument or
instruments, whatever its kind, and it was found out that some of these
instruments, because of their length and width could be a whip or stick or
something similar, as written in the prosecution report and these injuries
occurred on different dates because of the early and late stages of these
injuries, which proves the repetition of these acts of torture during the period
mentioned in the report. These injuries caused inflammations, because of the
infection all over the head, which caused infected septic inflammation inside
the head, which spread to the blood vessels inside the skull and caused a septic
inflammation of the brain meninges.

The in juries and bruises
of the victim happened at a time in accordance with the dates and the period of
time that was mentioned in the report of the prosecution and by Mostafa Helmy
Abdel Samie, that the victim was beaten by a whip and sticks for a number of
days.
11- Police Station of
Imbaba
On the 12th of
May 2002 the head of the security intelligence office of the Imbaba police
station and his assistant were sent to the Criminal Court on the account of
torturing a citizen to death and forging public records. On the 23/24 of April
2001, head of the security intelligence office Elsayyed Saeed El Baghdady and
chief Ehab Nagy Abdel Rahim assaulted and tortured Medhat Gaber Tadros in the
police station for his accusation of robbery. The head of the security
intelligence office electrified the victim's body which caused injuries that led
to his death to force him to confess his robbery. The assistant of the security
intelligence office forged the arrest record and untruthfully recorded that the
victim Medhat Tadris fainted during his questioning and used the forged record
and presented it to North Giza Accidents Prosecution. The prosecution started
its investigation with the accused and ruled the temporary detention of the
accused. The prosecution heard the testimony of three witnesses being

Khaled Elsayyed Megally Salama (36 years, Muslim carpenter)
He
stated that "while at home in Warraq area, Elsayyed El Boghdady, Ehab Nagy and
others arrested me and took me to the Imbaba police station and while in one of
the cells in the station I was surprised to find Medhat, accused in a robbery
case, at the same place, then the head of the security intelligence office
ordered him to strip, which he did. Then two people unknown to me tied him up;
his arms and legs, and started kicking him with their arms and feet and sticks.
Then the head of the security intelligence office electrified him in his left
ear and lower part of his body. I heard screams followed by silence.
2)
Nasr Gaber Tadros (brother of the victim, employee in the
Horeyya hospital in Shobra El Kheima)
He
stated that the first witness informed him of the death of his brother after
being electrified and tortured during his detention and that the second accused
was electrifying him.
3)
Nahed Boshra Wissa (victim's wife- housewife)
She
stated that her husband was arrested from their house intact and fully dressed
and that the police officers took from the apartment a TV and an iron machine
possessed by them, claiming they were stolen. The case is still being handled
and a hearing has not been set yet.
