Sudanese refugee swings between Interior's violence and UNHCR protection
EOHR's report on (29 / 12 / 2005) crucial events

According, EOHR demands the following procedures:
1) The Egyptian Government:
a- The Egyptian Government must apologise officially to Sudanese citizens assaulted in the dispersion process, supposing that it was legal, the assault also witnessed many violations during the forces' dispersion to the peaceful sit-in. According to the Egyptian civil law; stating 'causing harm to others imposes compensations', though EOHR calls the Government to give compensations to both Sudanese people and refugees.
b- Open investigations about the assault incident consequences affected the life of many refugees and the governmental officials -ordered to disperse the area using excessive violence- must be prosecuted before court, while the incident leads to the death of 29 refugees and hundreds injured. On the contrary, the Egyptian law must give legal refugees their official rights, and to protect their souls during their stay in Egypt.
c- Checking out the accurate numbers of the dead refugees and to give access to victims' kindred to enter the morgue to find out their dead, in which most of them were arrested during investigation for the arrested' names, numbers and place of detention, EOHR also calls for releasing the rest of the arrested immediately.
d- The Government must prevent driving away the Sudanese refugees from Egypt, in which this is considered a violation to 1951 Refugee Convention, Clause two of Article 33 that states 'Countries registered shouldn't drive away refugees by force to another country may violate his rights due to any reason related to origin, religion, nationality or adoption to any social sects or political opinion', this was the reason why Sudanese feared from returning again to their home land. Also forced immigration, is considered a violation to Combating Torture Convention, Clause one of Article 3 that states 'Countries work on the issue of combating torture shouldn't drive away refugees, if it found out that the citizen's return to his country will put him in danger of being abused or dehumanized'.
e- Establishing an independent fact-finding committee held by representatives of civil society and the National Council for Human Rights, in a stand to check out the incident's consequences, via visiting the injured and Sudanese refugees in camps to discover their complaints and tries to solve it.
f- The Government have to issue a legislation to reinforce the role of International Convention for Refugees Protection to identify their conditions in Egypt; on the one hand, Egypt was the sole Arab Country that participated in the eliminatory committee which carried out 1981 Convention. While on the other hand, the declared convention didn't witness any progress related to issuing legislation for refugees' conditions in Egypt, in addition, both the convention and the Constitution had the same base concerning giving the right to asylum, which sheds light on Egypt's obligations according to some governmental disagreements, in which refugees were subjected to many violations in their livelihood, details as follows:
a- They are forbidden to enter their children any Governmental schools in the primary stage.
b- In relation to work, they are treated as foreigners in terms of salary and work permission certificates, which contradict with the convention's provisions stating that refugees mustn't be treated as foreigners; they must have equal treatment with the citizens of the country concerning the type of work and the salary. Though refugees in Egypt are suffering from bad conditions and dehumanized treatment, this is due to UNHCR's minimum balanced sheet.
On this domain, EOHR calls the Egyptian Government to discard the reservations put on some articles of 1981 Convention, especially the one declared for the right to primary education related to work legislation and social security. On the other hand, EOHR also calls the officials in People's Assembly to prepare a bill to protect refugees' rights in Egypt, and also to amend Unified Work Law 12 [2003], that gives the refugee the chance to find job opportunity without being categorized a foreigner. The situation is not completely complicated, in which the Government didn't impose reservations neither on Article 17 related to work profit (salary), nor on Article 18 related to refugee personal employment.
Moreover it calls Foreign Affairs Ministry to change its strategy towards asylum seekers; especially the Sudanese abused in their countries, make excessive efforts to convince UNHCR to re-open communications with asylum seekers in Egypt and finally taking out a pledge from the Sudanese Government declaring that they will not use any abusive or dehumanized tools against the Sudanese who wants to return to their country.
2) The United Nations High Commissioner for Refugees (UNHCR):
According to EOHR's reports, it declares that UNHCR office carries the major responsibility to the assault happened against Sudanese refugees, and it demands the following:
a) Re-open the closed files of refugees in Egypt in general and Sudanese refugees in particular, and to facilitate the procedures done via giving asylum cards immediately to the ones who don't have it due to the office's bureaucracy. Refugees also must feel safe in Egypt until the Government declare their status according to [1951 Convention].
b) UNHCR must declare the situation clearly via discussing how the incident took place or inform about its responsibility to the whole act.
c) UNHCR must take an immediate act against refugees' immigration, and it must manage return procedures with the Sudanese Government to facilitate refugees' return to Sudan, in light that they may be subjected to the Government's forced migration. In which this act is considered a violation to the terms of International Convention for Refugees Protection 1951, which forbid forced migration.
d) Provide shelter for the assault victims who lost most of their official personal papers during dispersion, and to solve the problem of the lost belongings, UNHCR office must give the lost l belongings to the leaders of the sit-in immediately. Also they must let them return to one of the areas witnessed the incident to check the absent personal belongings, the Sudanese victims must be granted by the government and take compensations.
e) Start the declared schedule of executing refugees' demands without delay, in which the office marked out (17 /12/ 2005), beginning to the act of solving the Sudanese problems.
3) The Sudanese Government:
a) Sudanese Government has to facilitate Sudanese refugees' right to voluntary return to their home land.
b) Checking out Sudanese refugees' conditions during their re-settlement in the foreign countries, and give them the financial and individual support in their subjection to any crisis or violations.
Appendix:
1) List of names of the absents, arrested and dead;
2) The testimonial of the American University British Researcher to the sit-in dispersion incident;
3) A copy of EOHR's statements and reports (carry the dispersion incident details) presented to Interior and Foreign Affairs Ministries;
4) A copy of the presidential decree approved on establishing an administration for refugees' status held in the Egyptian Foreign Affairs Ministry and applying 1951 refugee Convention;
5) A copy of the convention held between the Egyptian Foreign Affairs Ministry and UNHCR office to apply 1951 Convention;
6) A statistical schedule of refugees' population in Egypt, prepared by UNHCR office, ends until April 2004.
